1. Introduction

These Merchant Terms & Conditions ("Terms") govern all purchases made through www.fifthsensesg.com (the "Site"), operated by Fifth Sense Pte Ltd ("Fifth Sense", "we", "us", "our"), a company incorporated in Singapore with UEN 202011772R and registered address at 54 Genting Lane, #06-01 Ruby Land Complex, Singapore 349562.

By placing an order through the Site, you ("Customer", "you") agree to be bound by these Terms. If you do not agree, please do not use the Site to make a purchase.

2. Products

Fifth Sense researches, develops, and sells in-house wellness and health supplement products. Product descriptions, images, and specifications on the Site are provided for general information and are as accurate as possible, but Fifth Sense does not warrant that all details are error-free.

Statements regarding our products have not been evaluated to diagnose, treat, cure, or prevent any disease, unless expressly stated with supporting regulatory approval. Customers with underlying health conditions, who are pregnant or nursing, or who are taking medication should consult a healthcare professional before use.

3. Pricing & Currency

All prices displayed on the Site are listed in Singapore Dollars (SGD) and are inclusive/exclusive of applicable taxes as indicated at checkout. Fifth Sense reserves the right to change prices at any time without prior notice; the price applicable to an order is the price displayed at the time of checkout.

4. Order Acceptance

All orders are subject to acceptance and availability. Fifth Sense reserves the right to refuse or cancel any order at its discretion, including in cases of suspected fraud, pricing errors, or stock unavailability. Where an order is cancelled after payment has been taken, a full refund will be issued to the original payment method.

5. Payment Methods

All payments on the Site are processed through Stripe, a secure, PCI-DSS Level 1 certified payment processor. Payment is completed entirely within Stripe's secure payment portal, and Fifth Sense does not collect, store, or have access to your full card number, CVV, bank account credentials, or other sensitive payment details at any point. Stripe handles all payment data directly, in accordance with its own security and compliance standards.

Through Stripe, we accept the following payment methods:

• Credit and debit cards (Visa, Mastercard, and other supported networks)

• Direct bank transfer

• PayNow

• PayLah!

Availability of specific payment methods may vary depending on your location and Stripe's supported options at the time of checkout.

6. Shipping & Delivery

We ship to addresses within Singapore and internationally. Estimated delivery times, shipping fees, and courier partners will be shown at checkout and may vary by destination. Fifth Sense is not responsible for delays caused by customs processing, local regulations, or courier service disruptions outside our control.

For international orders, the Customer is responsible for any customs duties, import taxes, or related fees levied by the destination country.

7. Refunds & Returns

Refunds and returns are governed by our Refund & Returns Policy. In summary: Fifth Sense does not offer refunds or returns for change of mind. For Singapore orders, customers may contact support within 5 days of delivery for issues such as damaged, defective, or incorrect items, and requests are reviewed on a case-by-case basis. International orders are final sale and not eligible for refund or return.

8. Limitation of Liability

To the fullest extent permitted by law, Fifth Sense's total liability arising from any order shall not exceed the amount paid by the Customer for that order. Fifth Sense shall not be liable for indirect, incidental, or consequential damages arising from the use of our products, except where such liability cannot be excluded under Singapore law.

9. Intellectual Property

All content on the Site, including product formulations, branding, images, and text, is the property of Fifth Sense Pte Ltd and may not be reproduced, distributed, or used without prior written consent.

10. Governing Law

These Terms are governed by the laws of the Republic of Singapore. Any disputes arising from these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the Singapore courts.

11. Changes to These Terms

Fifth Sense may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
